Terms of Service

Plain terms for a subscription service. If anything here is unclear, write to us and we will explain it rather than point at a clause.

1. Who these terms are between

These Terms of Service are an agreement between you and Anke LLC (“Anke LLC”, “we”, “us”), the company that provides the applications and services described on this website. By creating an account or using our software you accept these terms. If you do not accept them, do not use the service.

Our registration details and registered office are listed on the Company page.

2. Your account

An account is identified by a numeric account code issued when you register. We do not require your name or email address. The account code is the only way to access your account and your subscription — keep it safe. We cannot recover an account code that has been lost, because we hold nothing else that could prove the account is yours.

You are responsible for everything done through your account. If you believe someone else has your account code, contact support immediately and we will block it.

Each subscription permits a limited number of devices, shown on your subscription screen. Sharing your account code outside your household or organization is a breach of these terms.

3. Subscriptions, renewal and price

Subscriptions are sold for a fixed term, normally one month, and renew automatically at the end of each term until cancelled. Before you pay for the first time we show you the amount, the currency, the term and the renewal date.

We may change the price of a subscription. If we do, we will tell you before the change takes effect, and the new price applies from your next renewal, never retroactively. If you do not accept the new price, cancel before that renewal.

Where a purchase is made inside our mobile applications, the transaction is with Apple or Google under their terms, and cancellation and refunds are handled through the relevant store's own settings. Purchases made on our website are handled by us through a licensed payment processor.

4. Cancellation

You can cancel at any time. Cancellation stops the next renewal; your subscription continues to work until the end of the term you have already paid for. Cancelling is available inside the application and on the website, and takes no more steps than subscribing did.

Refunds are governed by our Refund and Cancellation Policy, which forms part of these terms.

5. Acceptable use

Your use of the service is subject to our Acceptable Use Policy. It comes down to this: do not use our software to break the law, to harm other people, to attack other systems or to interfere with the service itself. We may suspend or close an account that does, and we co-operate with properly issued legal requests.

6. Availability

We work to keep the service available continuously, but we do not promise that it will never be interrupted. Maintenance, network failures outside our control, and the acts of third parties can all cause downtime. Where an interruption is our fault and lasts long enough to matter, contact support and we will make it right.

7. Our intellectual property

The software, the website and everything in them remain ours. Your subscription is a licence to use the software, not a transfer of ownership. You may not copy, decompile, resell or redistribute the software except where the law says you may despite this clause.

8. Limits on our liability

Nothing in these terms excludes liability that cannot lawfully be excluded. Subject to that, our total liability to you for any claim arising out of the service is limited to the amount you paid us in the twelve months before the claim, and we are not liable for indirect or consequential loss.

9. Suspension and termination

We may suspend or close an account that breaches these terms, that is used fraudulently, or where we are required to do so by law or by our payment providers. Where we close an account that has not breached these terms, we refund the unused part of the current term.

You may close your account at any time from within the application. Closing an account deletes it and its data, and cannot be undone.

10. Changes to these terms

We may update these terms. The version in force is always the one published here, with the date it took effect at the top. If a change materially reduces your rights, we will give notice before it applies to you.

11. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States, and the courts of that state have exclusive jurisdiction, except where consumer protection law in your country of residence gives you the right to bring proceedings elsewhere.

Before starting proceedings, please write to legal@ankelabs.com. Most disputes are a misunderstanding and are settled in a day.
